Terms of Service
These Terms of Service ("Terms") govern your use of the Gradigo application and website (the "Service"), provided by Production da Vinci K.K. ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Acceptance and eligibility
You must be at least 13 years old to use the Service. If you are a minor under the age of majority where you live, you may use the Service only with the consent of a parent or guardian. If you do not agree to these Terms, do not use the Service.
2. Your account
You register with Google, Apple, or an email and password. You are responsible for keeping your credentials secure and for activity under your account. Provide accurate information and keep it up to date. Email sign-ups must verify their email address. You may delete your account at any time from Settings (see the Privacy Policy for what deletion removes).
3. The Service and your licence to use it
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own test preparation. The Service, including its question banks, explanations, curated vocabulary, articles, software, and design, is owned by us or our licensors and is protected by intellectual-property laws.
4. Gradigo Pro subscription
The Service offers a free tier with daily usage limits and an optional paid subscription, Gradigo Pro, which unlocks unlimited practice and Pro features.
- Price. Gradigo Pro is offered at ¥1,500 per month (approximately US$9.99) as of the effective date. The current price, currency, and any applicable tax are shown on the purchase screen at checkout, which is the authoritative price for your purchase; prices may change with notice.
- Free trial. New subscribers are offered a 7-day (one-week) free trial with full access. Unless you cancel before the trial ends, the trial automatically converts to a paid subscription and you are charged the then-current price.
- Auto-renewal. The subscription renews automatically for successive one-month periods unless cancelled. Your payment method is charged at each renewal until you cancel.
- One entitlement across platforms. Your Pro entitlement is managed by RevenueCat and applies across the devices where you sign in with the same account, regardless of where you purchased it.
5. How billing works per platform
Who charges you, and where you manage the subscription, depends on where you buy it:
| Platform | Processor / merchant | Manage & cancel | Refunds |
|---|---|---|---|
| iOS (App Store) | Apple is the merchant of record; charged to your Apple ID | App Store → your account → Subscriptions | Requested from Apple, subject to Apple's policy |
| Web | RevenueCat Web Billing via Stripe (card / Apple Pay / Google Pay). Chinese-language visitors are directed to the App Store instead | From the web app account settings / the billing portal provided at purchase | Requested from us via the contact below, subject to law and to Stripe/RevenueCat processing |
| Android | In-app purchase via Google Play is not currently offered; Android users may subscribe on the web | n/a until offered | n/a until offered |
For purchases made through the Apple App Store, Apple's own terms and refund policy govern the transaction, and cancellation must be done through your App Store account — we cannot cancel or refund an Apple transaction on your behalf.
6. Cancellation and refunds
You can cancel at any time using the method for your platform in §5. When you cancel, you keep Pro access until the end of the current billing period, and it does not renew after that. Except where required by law or by the applicable store's policy, payments are non-refundable and partial periods are not refunded. Deleting the app does not cancel a subscription.
7. Content, intellectual property, and acceptable use
The learning content in the Service is provided for your personal, non-commercial study only. You may not:
- copy, scrape, crawl, bulk-download, republish, sell, or redistribute the question banks, vocabulary, explanations, or other content, in whole or in part;
- use automated means (bots, scrapers, or harvesters) to access or extract content or data from the Service;
- reverse-engineer, decompile, or attempt to derive the source or the underlying data set, except to the extent this restriction is prohibited by law;
- use the Service or its content to build or train a competing product or a machine-learning model.
These restrictions apply to all content now in the Service and to protected content we add in future. We reserve all rights not expressly granted.
8. Prohibited conduct
You agree not to misuse the Service, including by: breaking the law; infringing others' rights; attempting to gain unauthorised access to accounts or our systems; interfering with or overloading the Service; circumventing usage limits, security, or the paywall; sharing or reselling your account; or manipulating the referral programme (for example with fake or self-referred accounts).
9. Test names and third-party services
GRE, GMAT, TOEFL, and IELTS are trademarks of their respective owners (ETS, GMAC, and the IELTS partners). Gradigo is an independent preparation tool and is not affiliated with, endorsed by, or sponsored by any of these organisations. Score estimates in the Service are indicative only and do not guarantee any official result. The Service relies on third-party providers (see the Privacy Policy); their availability is outside our control.
10. Availability, changes, and suspension
We may modify, suspend, or discontinue parts of the Service, and may update these Terms. For material changes we will give reasonable notice (for example, in the app or by email); continued use after a change takes effect means you accept the updated Terms. We may suspend or terminate your access if you breach these Terms or use the Service in a way that harms it or other users.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including as to accuracy of content or fitness for a particular purpose. We do not warrant that use of the Service will achieve any particular test score.
To the fullest extent permitted by law, our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the month preceding the event giving rise to the liability, or ¥1,000. Nothing in these Terms limits liability that cannot be limited by law (including liability for wilful misconduct or gross negligence).
12. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the Service is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. Mandatory consumer-protection rights in your country of residence are unaffected.
13. Contact
